Dying without a will (intestate): what will your spouse get and children receive?

A spouse will get the first $200,000 of an estate. If you have one child then your spouse will get 50% of the remainder and the child the other 50%. If you have more than one child the spouse’s share is reduced to 1/3 and the rest is shared between your children. Non-married couples are not recognized. A spouse can apply for a greater percentage of the remainder of the estate.

How many witnesses are necessary for a will in Ontario?

Two.

Are holographic (handwritten) wills legal in Ontario?

Short answer = yes. Long answer = yes, but… a handwritten will is much more likely to lead to dispute than a professional will done online or with a lawyer. If you make one in an emergency you should ensure you do a professional will soon afterwards. Disputes at court can cost tens of thousands of dollars (or more).
